§ 1 GENERAL PROVISIONS

The store www.fascialmanipulation.de operates in accordance with the terms and conditions set forth in these Regulations.

The Regulations specify the terms and conditions for concluding and terminating Product Sales Agreements and the complaint procedure, as well as the types and scope of services provided electronically by the www.fascialmanipulation.de Store, the rules for providing these services, and the terms and conditions for concluding and terminating agreements for the provision of electronic services.

Every Service Recipient, upon taking steps to use the Electronic Services of the www.fascialmanipulation.de Store, is obliged to comply with the provisions of these Regulations.

In matters not covered by these Regulations, the following provisions shall apply:

the Act on Providing Services by Electronic Means of 18 July 2002,
-
the Consumer Rights Act of 30 May 2014,
-
the Act on Extrajudicial Settlement of Consumer Disputes of 23 September 2016,
-
the Civil Code Act of 23 April 1964 and other relevant provisions of Polish law.
§ 2 DEFINITIONS CONTAINED IN THE REGULATIONS

ORDER FORM – a form available on the website www.fascialmanipulation.de that enables the placement of an Order.

CUSTOMER – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.
-
CONSUMER – a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
-
ENTREPRENEUR – a natural person, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, conducting business or professional activity in its own name.

PRODUCT – a movable item available in the Store which is the subject of a Sales Agreement between the Customer and the Seller.
-
REGULATIONS – these Store regulations.
-
STORE – the Service Provider’s online store operating at www.fascialmanipulation.de.
-
SELLER, SERVICE PROVIDER – www.fascialmanipulation.de
-
SALES AGREEMENT – a Product Sales Agreement concluded between the Customer and the Seller via the Store.
-
ORDER – the Customer’s declaration of intent constituting an offer to conclude a Product Sales Agreement with the Seller.
-
PRICE – the value expressed in monetary units that the Customer is obliged to pay to the Seller for the Product.
§ 3 INFORMATION REGARDING PRODUCTS AND ORDERING

The Store www.fascialmanipulation.de sells Products via the Internet.
-
Products offered in the Store are new, consistent with the agreement, and have been legally introduced to the German market.

Information on the Store’s website does not constitute an offer within the meaning of the law. By placing an Order, the Customer makes an offer to buy a specific Product under the conditions specified in its description.

The Product Price displayed on the Store’s website is given in Polish Zlotys (PLN) and includes all components. The Price does not include delivery costs.

Orders can be placed via the website using the Order Form (Store www.fascialmanipulation.de) – 24 hours a day, all year round.

A condition for placing an Order in the Store by the Customer is reading the Regulations and accepting its provisions at the time of placing the Order.
§ 4 CONCLUDING A SALES AGREEMENT

To conclude a Sales Agreement, it is necessary for the Customer to place an Order in advance using the method provided by the Seller, in accordance with § 3 points 5 and 6 of the Regulations.

After placing the Order, the Seller immediately confirms its receipt.

Confirmation of acceptance of the Order binds the Customer to their Order. Confirmation of receipt occurs by sending an e-mail.
-
The confirmation of receipt of the Order contains: confirmation of all essential elements, a withdrawal form, and these Regulations with instructions on the right to withdraw.

Upon receipt of the e-mail by the Customer, a Sales Agreement is concluded.

Each Sales Agreement will be confirmed by a proof of purchase attached to the Product.
§ 5 PAYMENT METHODS

The Seller provides the following payment methods:

payment by traditional bank transfer to the Seller’s bank account,
-
payment realized via the PayPal system.

For traditional transfer, payments should be made to: DE21 1307 0024 0488 1348 00 (Deutsche Bank), BIC/SWIFT: DEUTDEDBROS. Title: “Order No. …”.

The Customer is obliged to pay within 2 working days from the date of conclusion, unless stated otherwise.
-
The Product will be sent only after payment is received.
§ 6 COST, TIME, AND METHODS OF PRODUCT DELIVERY

Delivery costs are determined during the Order placement process.

The delivery date consists of:

Products are sent via the DPD courier company.
§ 7 PRODUCT COMPLAINTS

Complaint for lack of conformity of the Product with the agreement.

Seller’s liability towards Consumers is specified in the Consumer Rights Act of 30 May 2014.
-
Seller’s liability towards Entrepreneurs is specified in the Civil Code Act of 23 April 1964.
-
The Seller is liable for any lack of conformity existing at delivery and disclosed within 2 years.

Notifications can be made via e-mail to: berlin@fascialmanipulation.de.

Please provide the type and date of the irregularity and contact details.

The Consumer is obliged to make the Product available to the Seller for assessment.
-
The Seller will respond within 14 days. Failure to do so for a Consumer complaint is equivalent to its acceptance.

Response is provided on a durable medium (e.g., e-mail).
§ 8 RIGHT OF WITHDRAWAL

A Consumer may withdraw from a distance agreement within 14 days without giving a reason.

Upon withdrawal, the agreement is void. The Consumer must return the Product within 14 days.

The Consumer is liable for any decrease in value resulting from use beyond what is necessary to establish its nature.

The Seller shall refund the value and delivery costs using the same payment method.
-
The Consumer only bears the direct cost of returning the Product.
§ 9 TYPE AND SCOPE OF ELECTRONIC SERVICES

The Service Provider enables the conclusion of Sales Agreements via the Store.
-
Electronic Services are provided on the terms specified in the Regulations.
-
The Service Provider may post advertising content on the Store’s website.
§ 10 TERMS OF PROVIDING ELECTRONIC SERVICES

Provision of the Order Form service is free of charge.
-
Technical requirements: device with Internet access, e-mail, browser with Cookies and Javascript enabled.

The Service Recipient is prohibited from providing unlawful content.
§ 11 COMPLAINTS REGARDING ELECTRONIC SERVICES

Complaints regarding Electronic Services can be submitted to: berlin@fascialmanipulation.de.

The Service Provider will consider the complaint within 14 days.
§ 12 FINAL PROVISIONS

Agreements are concluded in accordance with Polish law.
-
Disputes with Consumers will first be settled through negotiations for an amicable settlement.
-
If an amicable settlement is not possible, disputes shall be resolved by the competent common court.
-
Consumers have the right to use extrajudicial dispute resolution methods.
